The Supreme Judicial Court affirmed Defendant’s conviction for operating under the influence (OUI), operating after habitual offender revocation, and driving to endanger, entered by the trial court after a jury trial. The court held (1) the trial court did not abuse its discretion in denying Defendant’s motion for a mistrial after an officer testified that Defendant was on probation at the time of his arrest; (2) the prosecutor did not commit misconduct; and (3) the trial court did not err by not instructing the jury on the competing harms justification as to the charges of operating under the influence and driving to endanger.
